Costa Rica is a Latin American country with great sandy beaches, volcanoes, and tropical mountains. With the Caribbean on one side, the Pacific on the west, and wonderful warm blue waters teeming with fish, it is an ideal vacationing spot. In fact, it is one of the most visited countries in Central America. The tourist influx has created a booming industry with many resorts, inexpensive hostels, hotels, golf courses, restaurants, casinos, pubs, and locales catering to adult activities. As it is being discovered, more and more Americans, Canadians, and Europeans have chosen to live there full or part time with thousands owning second homes along the spectacular beaches or tropical mountains. Foreigners can own property in Costa Rica and tens of thousands live here year-round because of its democratic government, tropical climate, reasonable land prices, and spectacular laid-back natural environment. All this in turn has led to an increase in Costa Rica real estate prices, particularly along the magnificent Pacific coast where most of the tourists go.

This relative scarcity of available real estate in the face of development has resulted in a boom in the real estate business along the coasts, in the mountains, and in urban areas.

For more and more Americans, Canadians, and Europeans, Costa Rica is now recognized as the ideal place to spend their retirement days. Every contraction sets the stage for recovery. Costa Rica is expected to boom again due to the continuing tourist influx into the country, the high returns that real estate investment yields here, and the increasing scarcity of land in some places. Over the last decade, many investors have seen the value of their investments soar, though there is in fact a pull-back today in some areas because of the worldwide recession. Even many small investments have proved to be lucrative. Tempering the future boom a bit, though, may be that the fact that property in highly desired areas is becoming increasingly scarce. On the other hand, this may lead to increased investment in prime real estate inland.

The beach properties along the Pacific coast have seen, and will probably see, the largest increase in prices over time. The Caribbean coast remains relatively undeveloped. Certainly prices there, like all of Costa Rica, are rising but not nearly as much as on the other coast (which, of course, means that stress on prices have been less lately than on the Pacific side). And, as more and more Ticos move from the country into the big urban area around San Jose, available prime property has become increasingly scarce. Demand remains strong in the urban areas and, for more and more expats who live in Costa Rica, the amenities and climate around San Jose are proving irresistible.

It seems that Brazil is the place to watch. Its economy is thriving, its property market is booming and more and more tourists are choosing to experience its delights than ever before.

Brazil is also home to some of the most healthy and exotic foods available, no more so than the famous Amazon region where the trees of the rainforest simply groan under the weight of hundreds of different types of tropical fruit. Many of these have been discovered to offer significant health benefits and suddenly names such as pupunha, capuau and grumixama are tripping off peoples tongues in juice bars and cafs from North to South. It is the aai berry, though, that is unarguably responsible for the Brazilian health food revolution that is taking not just Brazil but also the US by storm.

The acai berry is small and purplish in colour and grows on the acai palm that is native to the Amazon. The berry has been used for centuries by those in the know to give them an energy surge and boost their physical strength. It is also well known for providing extra nutritional value to a diet.

Acai has now been discovered to be one of the most nutrient-rich and potent superfoods on the planet. It is simply loaded with antioxidants, phytonutrients, anthocyanins, amino acids, essential omegas, fibers and protein. Purchasing Real Estate in Brazil, the Role of the Lawyer, Part 1.

It is essential that you engage the services of a lawyer when purchasing land or property in any country where you are not normally resident. Brazil is no exception, even though it has very strong consumer and title laws, the differences in language and terminology can result in misunderstandings that could damage your investment.

Obviously one of the main criteria in selecting a lawyer to act for you will be the sharing of a common language and experience of working with non-resident real estate transactions. The OAB, Brazilian Bar Association, has a register of accredited lawyers and they have a published scale of fees for the legal work they carry out.

The lawyer will be responsible for advising you on the reservation contract, purchase contract and the legal implications of these documents. With its consumer laws very much in favour of the purchaser, Brazil is a very safe environment in which to purchase property. Your purchase can be very swift if all of the correct documents are in place. With older properties or land your lawyer will have to collect all of the correct documents, which my take a little more time.

The type of service that will be provided to you by your lawyer will vary greatly and be dependent upon the type of real estate that you are purchasing. An off-plan apartment will have most of the required documents in place, as the documents will have been required for the planning permission process. In older country and beach properties, your lawyer will be required to make a far more extensive inspection of the documentation, as there may be issues with regard to ownership, as some older properties may not have registered their title.

The process of buying land is the same as property except that you will have a report prepared which will set out the borders and size of the land. The report will also give the urbanistic characteristics of the land stating what can be built on the land, as well as a detailed plan for inclusion in your title deeds.

When your lawyers have confirmed that the property is legally ready for sale, with all documentation in place, you will then sign the purchase contract known as, contrato de compra e venda. The contract details all of the information with regard to the purchase such as the seller, the buyer, description of property, price and so on. Importantly it also sets out the date that you can take possession of the property.

With the contrato de compra e venda signed by both parties and with the deposit paid, the contract becomes a legally binding document. The amount payable as deposit at this stage and the structure of payments until completion varies, particularly in the case of off plan property purchase as different developers offer different payment schedules and incentives.

In order to receive your title deeds, which ensure the property is legally yours, the property needs to be paid in full and the transfer taxes paid.
